Term & Conditions For Bexpress Courier & Cargo Franchise
The applicant(s) should have their own office (may be rented) in minimum 100 sq. ft. area with telephone facility available on the easily approachable location / road.
The applicant(s) will be fully responsible to bear all liabilities such as office expenses, premises, telephone bills, electricity bills, staff salaries, services tax & any type of state and central govt. dues etc. Company will not be responsible for any liabilities pertaining to applicant’s office or violation of any Act/Rules/Regulations of state & central govt.
The applicant(s) will raise the bills “ including service tax “ in the own clients, and in any circumstances they will not submit the bills in the name of Bexpress Courier & Cargo Pvt.Ltd.. The applicant being an independent authority shall be responsible for supervision of his office & work .Applicant will claim only third party commission, application will have no administrative relation with the Company.
The applicant(s) will be obtained all type of approval / license/ registration from state and central govt. department for running the said business in their name and copies of all registration to be submitted at the time of franchise agreement or within 15 days after signing of franchise agreement. Company will not be responsible for any penalties imposed by the any dept.
No security will be deposited, only our time brand & marketing fee which will be non-refundabe/transformable taken by company.
The applicant(s) will obtain a FDR of nationalize bank against deposit security at the time of franchise agreement or within 30 days for a tenure period 10 years from the Company.
The applicant(s) will maintain absolute integrity without giving room of doubt, scope for complaints of any short from the customers/ clients and shall keep and informed to the Company in writing about the same of complaints against the Company, the same will be forwarded to the Company for appropriate action.
The applicant(s) will hand over their load keeping in the mind cut off timings under booking sheet advice. Applicant(s) to ensure that yours booking sheet are completed in all weight and destination should be mentioned correctly. In case of any differences / discrepancy in weight is found, such consignments shall not be connected by the Company.
The applicant(s) will use booking sheet in sequence like No. of serial no. should be left on daily basis. in case there is no booking on any day , booking sheet should be marked ‘NIL’& sent to Head office for verification &record.
Non docs should be accompanied with all necessary papers like invoice/declaration / way bill/ form 38 & 39 etc. while booking & handing over the load. Applicant(s) also ensure all shippers should be signed by the consignors while booking the consignments.
The applicant(s) will make the payment within one month’s from the date of submission of the bill. In case of delay @24% pa will be imposed for delayed payment. If payment is not make after 40 days load will be taken on the cash &carry basis.
The applicant(s) will have to make the payment as per the price list which will be provided by the Company time to time.
The applicant(s) will not approach to any existing client being serviced either directly by the Company or any of its authorized agencies. It this is established for any reason whatsoever, the agencies arrangement shall be terminated without giving notice.
In case of settlement of compensation to the client in any means, final decision shall be of the Bexpress Courier & Cargo Pvt.Ltd. and both of us will bear 50-50 of the compensation whatsoever may be reason or fault.
Bexpress Courier & Cargo Pvt.Ltd. will not be held responsible, if a client is lost due to any reason.
Bexpress Courier & Cargo Pvt.Ltd. will try their level best to transport the consignments within the delivery scheduled, but the delay, if any shall not give any right not to make payment or without our payment in any circumstances.
For all intents and purpose this agreement shall be treated to the entered into executed at ha, and the disputes and differences for adjudication shall be subject to the territorial jurisdiction of the courts situated at Hyderabad.
The applicant(s) has to follow all the rules & regulations of the company conveyed to them.
The applicant(s) has to obtain prior permission in the case of shifting of office to any other place.
The applicant(s) can’t start the business till the receipt of business commencement certificate / authority letter / franchise allotment letter issued by our representative / regional office after agreement fee , brand fee & marketing fee and company other formalities.
Franchisee / Agency arrangement is non transferable applicant(s) can’t sell / transfer his franchise/agency arrange to third party applicant can’t open any extension counter or office than one place without approval from the Company
